These Terms of Service ("Terms") govern your access to and use of SafeBoat ("Service"), an email deliverability testing platform operated by Mindpress Technologies ("Company", "we", "us", or "our").
By accessing or using SafeBoat, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Definitions
- "Account": Your registered user account on SafeBoat
- "Test Box": An email account configured for deliverability testing
- "Seed Account": Recipient email accounts used for inbox placement testing
- "Test": An email deliverability check performed through the Service
- "Tenant": Your organization's isolated workspace within SafeBoat
- "Content": Any data, text, emails, or other materials you submit to the Service
2. Account Registration
2.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately at wehearyou@safeboat.app of any unauthorized access
2.2 Account Security
- Use strong, unique passwords
- Enable two-factor authentication when available
- Do not share your account credentials with anyone
- We are not liable for losses caused by unauthorized use of your account
3. Acceptable Use Policy
3.1 Permitted Use
SafeBoat is designed for legitimate email deliverability testing and monitoring. You may use the Service to:
- Test inbox placement of your marketing emails
- Monitor email deliverability trends
- Diagnose email delivery issues
- Optimize email campaigns for better inbox placement
3.2 Prohibited Activities
You agree NOT to:
- Send spam, unsolicited emails, or bulk commercial emails through the Service
- Test emails containing malware, viruses, or malicious code
- Use the Service to harass, abuse, or harm others
- Attempt to bypass authentication or security measures
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for illegal activities or to violate laws in India or your jurisdiction
- Share or resell your account access to third parties
- Send test emails that violate third-party rights (copyright, trademark, privacy)
- Use automated tools to scrape or extract data from the Service
- Overload or interfere with the Service's infrastructure
3.3 Email Content Restrictions
Test emails must comply with:
- CAN-SPAM Act, GDPR, and applicable anti-spam regulations
- Content must not contain illegal material, hate speech, or adult content
- You must have rights to all content included in test emails
- Test emails must not impersonate others or misrepresent sender identity
3.4 Enforcement
Violation of this Acceptable Use Policy may result in:
- Immediate suspension or termination of your account
- Removal of violating content
- Reporting to law enforcement authorities
- Legal action to recover damages
4. Service Limits and Fair Use
4.1 Usage Limits
Your plan includes the following limits:
- Test Boxes: Up to 100 email accounts per tenant
- Tests: Up to 1000 tests per billing period
- Seed Accounts: As allocated to your tenant's seed group
- API Requests: Rate limits apply (details in API documentation)
4.2 Fair Use
We reserve the right to throttle or suspend accounts that:
- Exceed reasonable usage patterns
- Generate excessive API calls
- Consume disproportionate system resources
- Impact service availability for other users
5. Data Privacy and Security
5.1 Data Collection
We collect and process:
- Account information (name, email, organization)
- Email credentials for Test Boxes (encrypted with AES-256)
- OAuth tokens for connected email providers (Google, Outlook, Zoho)
- Test results and deliverability metrics
- Usage analytics and logs
5.2 Data Security
We implement industry-standard security measures:
- AES-256 encryption for sensitive credentials
- TLS/SSL for data in transit
- Regular security audits and updates
- Access controls and authentication mechanisms
- Secure backup and disaster recovery procedures
5.3 Data Retention
- Active account data: Retained while your account is active
- Test results: Retained for 12 months unless deleted earlier
- Deleted data: Permanently removed within 30 days of deletion request
- Backups: May persist in backups for up to 90 days
5.4 Data Ownership
- You retain ownership of all Content you submit
- You grant us a license to process your Content to provide the Service
- We do not sell your data to third parties
- We may use aggregated, anonymized data for analytics and improvements
5.5 Third-Party Email Providers
When you connect email accounts via OAuth:
- We access only the permissions you explicitly grant
- We do not read your personal emails beyond test messages
- OAuth tokens are encrypted and stored securely
- You can revoke access at any time through your email provider settings
6. Payment Terms
6.1 Pricing
- Subscription fees are displayed on our pricing page
- Prices are in Indian Rupees (INR)
- Prices may change with 30 days notice to existing subscribers
6.2 Billing
- Subscription fees are billed monthly or annually in advance
- Payment methods: Razorpay, credit card, debit card, UPI, net banking
- Automatic renewal unless canceled before renewal date
- No refunds for partial months or unused services
6.3 Taxes
- Prices exclude GST and other applicable taxes
- You are responsible for all taxes associated with your purchase
- We will collect and remit taxes as required by Indian law
6.4 Payment Failures
- Failed payments may result in service suspension
- You will receive notification before suspension (3-7 days grace period)
- Accounts suspended for 30+ days may be deleted
- Past-due amounts may be sent to collections
7. Intellectual Property
7.1 Our Rights
SafeBoat and all related trademarks, logos, and service marks are owned by Mindpress Technologies. The Service's code, design, features, and documentation are protected by copyright and other intellectual property laws.
7.2 Your Rights
You retain all rights to Content you submit. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display your Content solely to provide and improve the Service.
7.3 Restrictions
You may not:
- Use our trademarks without written permission
- Copy, modify, or create derivative works of the Service
- Remove or alter any proprietary notices
- Claim ownership of any part of the Service
8. Service Availability
8.1 Uptime
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.
8.2 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any feature with 30 days notice
- Update the Service for security, legal, or operational reasons
- Change APIs and integrations (with reasonable notice to developers)
8.3 No Warranty
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF SAFEBOAT SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE ARE NOT LIABLE FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
- WE ARE NOT LIABLE FOR THIRD-PARTY ACTIONS (e.g., email providers blocking your emails)
- WE ARE NOT LIABLE FOR DAMAGES CAUSED BY YOUR VIOLATION OF THESE TERMS
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Mindpress Technologies, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of SafeBoat
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the Service
- Your breach of applicable laws or regulations
11. Termination
11.1 Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in settings
- Contacting support at wehearyou@safeboat.app
- No refunds for prepaid periods
11.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms or Acceptable Use Policy
- Your account is inactive for 12+ months
- We are required to do so by law
- You engage in fraudulent activity or abuse
- You fail to pay subscription fees
11.3 Effect of Termination
Upon termination:
- Your access to the Service ends immediately
- We may delete your data after 30 days
- You remain liable for any outstanding fees
- Sections that should survive termination will remain in effect (Liability, Indemnification, Dispute Resolution)
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles.
12.2 Jurisdiction and Venue
Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts located in Srinagar, Jammu & Kashmir, India. You consent to the personal jurisdiction of these courts.
12.3 Arbitration
Before filing a lawsuit, parties agree to attempt resolution through arbitration under the Indian Arbitration and Conciliation Act, 1996. Arbitration shall be conducted in Srinagar, Jammu & Kashmir, with one arbitrator mutually agreed upon by both parties.
12.4 Exceptions
Either party may seek injunctive relief in court for:
- Intellectual property violations
- Breach of confidentiality
- Urgent security matters
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via:
- Email to your registered address
- Notice on the SafeBoat dashboard
- Announcement on our website
Continued use of the Service after changes constitute acceptance. If you do not agree to updated Terms, you must stop using SafeBoat and may terminate your account for a pro-rated refund (if applicable).
14. GDPR and International Compliance
14.1 Data Subject Rights (GDPR)
If you are in the European Union, you have the right to:
- Access your personal data
- Correct inaccurate data
- Request deletion of your data
- Object to or restrict processing
- Data portability
- Withdraw consent

We primarily store data in India. International data transfers comply with applicable data protection laws.
15. Miscellaneous
15.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Mindpress Technologies regarding SafeBoat.
15.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
15.3 Waiver
Failure to enforce any right does not waive that right.
15.4 Assignment
You may not assign these Terms without our consent. We may assign our rights and obligations to any successor entity.
15.5 No Agency
These Terms do not create a partnership, agency, or employment relationship.
15.6 Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, government actions, pandemics, internet outages).
15.7 Export Compliance
You agree to comply with all export and import laws applicable to the Service.
